Welcome to PELVARO. Please read these Terms of Service ("Terms") carefully before using the website located at pelvaro.com (the "Site") or placing any order with PELVARO. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. The Parties

These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and PELVARO ("PELVARO," "we," "us," or "our"), a business operating in the United States with its principal place of business in Nashville, Tennessee.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a contract to use this Site or place an order. By using the Site, you represent and warrant that you meet these requirements. If you are using the Site on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

3. Products and Availability

All product descriptions, specifications, and images on the Site are provided in good faith. We reserve the right to:

  • Modify, discontinue, or limit the quantity of any product without notice
  • Correct any errors, inaccuracies, or omissions in product information at any time
  • Cancel any order if a product is found to be mispriced or incorrectly described after the order is placed

Product colors may vary slightly from their representation on screen due to monitor calibration differences. Natural materials (wood, bamboo, leather) will exhibit natural grain, color, and texture variation from piece to piece — this is a characteristic of premium natural materials and is not a defect.

4. Pricing and Payment

All prices are displayed in US Dollars (USD) and are inclusive of applicable product taxes where required by law. Prices do not include shipping charges, which are calculated and displayed at checkout.

We accept the following payment methods: major credit and debit cards (Visa, Mastercard, American Express, Discover), Shop Pay, PayPal, Apple Pay, and Google Pay. Payment is processed at the time of order placement.

We reserve the right to change prices at any time without prior notice. Price changes do not affect orders that have already been confirmed.

5. Order Confirmation and Contract Formation

Placing an order on the Site constitutes an offer to purchase the specified items. A binding contract is formed when we send you an order confirmation email. We reserve the right to decline any order for any reason, including suspected fraud, payment issues, or product unavailability.

If we cancel an order after payment has been collected, we will issue a full refund to your original payment method within 3 – 5 business days.

6. Shipping and Delivery

Shipping terms are governed by our Shipping Policy, which is incorporated into these Terms by reference. Risk of loss and title for items purchased from PELVARO pass to you upon delivery to the shipping carrier. We are not responsible for loss or damage that occurs during transit after transfer to the carrier, but we will assist in filing claims and, where appropriate, provide replacements.

7. Returns and Refunds

Returns and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

All content on the Site — including but not limited to text, product descriptions, photographs, graphics, logos, icons, audio clips, and software — is the property of PELVARO or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, publish, display, modify, create derivative works from, sell, or exploit any content from the Site without our prior written permission. The PELVARO name, logo, and all related marks are trademarks of PELVARO and may not be used without explicit written authorization.

9. User Accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. PELVARO is not liable for losses resulting from unauthorized use of your account.

We reserve the right to suspend or terminate accounts at our discretion, particularly where accounts are used in violation of these Terms or applicable law.

10. Prohibited Conduct

You agree not to use the Site to:

  • Violate any applicable law or regulation
  • Submit false, misleading, or fraudulent orders or information
  • Engage in unauthorized data collection, scraping, or harvesting
  • Interfere with or disrupt the Site's operation or security
  • Transmit viruses, malware, or other harmful code
  • Infringe the intellectual property rights of PELVARO or any third party
  • Attempt to gain unauthorized access to any portion of the Site or its related systems

11. Reviews and User-Submitted Content

If you submit a product review, comment, or other content to the Site, you grant PELVARO a non-exclusive, royalty-free, perpetual license to use, display, reproduce, and distribute that content in connection with our business. You represent that you are the owner of such content and that it does not infringe any third-party rights.

We reserve the right to remove any user-submitted content that is false, defamatory, obscene, or otherwise objectionable, at our sole discretion.

12. Disclaimer of Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES OFFERED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PELVARO DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SITE IS AT YOUR OWN RISK.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PELVARO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCTS PURCHASED FROM US, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF PELVARO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL PELVARO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE RELEVANT ORDER(S) IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless PELVARO and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, violation of these Terms, or infringement of any third-party rights.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Site shall first be subject to good-faith negotiation between the parties for a period of 30 days. If unresolved, disputes shall be submitted to binding arbitration in Nashville, Tennessee, under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction for intellectual property violations or emergency relief.

By accepting these Terms, you waive your right to participate in any class-action lawsuit or class-wide arbitration.

16. Force Majeure

PELVARO shall not be liable for any failure or delay in performing obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, carrier disruptions, labor disputes, or infrastructure failures.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with the revised "Last updated" date. Your continued use of the Site after such modifications constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and PELVARO with respect to the subject matter hereof and supersede all prior agreements, representations, and understandings.
